Falcon Labs – Ad Unit Privacy Policy

This Privacy Policy explains how Falcon Digital Labs LLC (“Falcon,” “we,” “our,” or “us”) collects and uses personal data when you interact with advertisements and offers displayed through the Falcon ad unit (the “Ad Unit”). This Policy is specific to the Ad Unit and is intended to provide transparency about our practices in compliance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR), the UK GDPR, the Swiss Data Protection Act, and U.S. state privacy laws such as the California Consumer Privacy Act (CCPA/CPRA).
1. Information We Collect
When you interact with the Ad Unit, we may process:
- Publisher-provided identifiers: e.g., first name, email address, or other details the website or app provides to us.
- Interaction data: e.g., whether you viewed, clicked, or dismissed an offer.
- Technical data: e.g., IP address, device/browser type, and activity logs needed to display and secure the Ad Unit.
What we do not collect:
- We do not track your browsing history after you leave the Ad Unit.
- We do not collect or monitor your activities on an advertiser’s site.
- We do not sell personal data.
2. How We Use the Information
We use this data only to:
- Display and personalize the Ad Unit (for example, greeting you by first name, if provided by the publisher).
- Direct you to the advertiser’s website when you choose to engage with an offer.
- Ensure security, prevent fraud, and measure performance of the Ad Unit.
- Comply with applicable laws and regulations.
We do not use Ad Unit personal data for cross-site behavioral profiling or unrelated marketing.
3. Your Choices and Consequences
- You are under no obligation to click on or engage with offers in the Ad Unit.
- You can continue using the publisher’s site or app whether or not you engage with offers.
- If you choose to engage, we may transmit limited data (e.g., your first name if necessary to pre-populate a form).
4. Relationship with Publishers and Advertisers
- Publishers: The site or app where you see the Ad Unit may share limited data with Falcon. Publishers remain responsible for their own data collection and disclosures.
- Falcon: We process publisher-provided data as a service provider/processor, and we process Falcon Data (aggregated logs, fraud detection, metrics) as an independent controller.
- Advertisers: Once you click through to an advertiser’s site, their privacy policy governs. Falcon does not collect personal data on advertiser websites.
5. Cookies and Tracking Technologies
The Ad Unit may use cookies, pixels, SDKs, or device identifiers to:
- Measure engagement (impressions, clicks, dismissals).
- Prevent fraud and ensure proper delivery of ads.
We do not use these technologies for behavioral advertising across third-party sites. You can manage cookies via your browser or operating system settings.
6. Legal Bases for Processing (GDPR/UK GDPR)
Under Article 6 GDPR, we rely on the following legal bases for processing:
- Consent (Art. 6(1)(a)): When you click or engage with an offer.
- Legitimate interests (Art. 6(1)(f)): Operating and securing the Ad Unit, measuring performance, preventing fraud.
- Legal obligation (Art. 6(1)(c)): Where required to comply with laws or respond to authorities.
7. Data Sharing
We may share data as follows:
- With Advertisers: Only when strictly necessary to complete your chosen interaction (e.g., pre-populating your first name in a form).
- With Service Providers: Trusted vendors supporting hosting, analytics, or fraud detection.
- For Legal Reasons: If required by law, regulation, or to protect our rights.
We do not “sell” or “share” personal data as defined by the CCPA/CPRA.
8. International Data Transfers
If your data is transferred outside your home country, Falcon uses lawful transfer mechanisms:
- EU Standard Contractual Clauses (Arts. 46–47 GDPR).
- UK Addendum to the SCCs.
- Swiss Addendum where applicable.
We also apply technical and organizational safeguards (encryption, minimization, role-based access).
9. Data Retention
- Interaction logs: retained 30–90 days for fraud prevention and reporting.
- Aggregated/de-identified data: retained longer for analytics and product improvement.
- Legal records: retained as required by law.
Data is securely deleted or anonymized when no longer needed (consistent with Art. 5(1)(e) GDPR).
10. Children’s Privacy
The Ad Unit is not directed at children under 16. We do not knowingly process children’s personal data for ad personalization (Art. 8 GDPR). If we learn we have inadvertently collected data from a child, we will delete it.
11. Your Rights
Under Articles 15–22 GDPR (and equivalent rights under UK and Swiss law), you may have rights including:
- Access, correction, deletion, and portability of your data.
- Restriction of processing.
- Objection to processing (including personalization).
- Withdrawal of consent at any time (without affecting prior lawful processing).

12. U.S. State Privacy Rights (CCPA/CPRA and others)
If you are a California resident (or a resident of states with similar laws):
- Falcon does not sell or share your personal data.

13. Security Measures
We protect data through measures consistent with Article 32 GDPR, including:
- Encryption in transit and at rest.
- Role-based access and authentication controls.
